    am i legally required to pa rent on an apartment unit that violates implied warranty of habitability; building has been cited with numerous violations by code inspector. apartment is rent stabilized in los angeles. thanks.

    Good morning, I have a group of tenants who are interested in organizing a tenants rights group to advocate for themselves in HUD housing. The only issue is that they are project based vouchers instead of an individual’s Housing Section 8 voucher. Will you be able to help them learn to organize?

    My name is Evelyn Renee McLaughlin and I live at West Hyland’s Apartments (Tidmore Management Corp) 737 W College Street, #22, Athens TX 75751 which is a HUD apartment and I’m on disability.


    I moved here on July 24th 2017 and the deposit was at $400.00 and pet deposit $150.00 – I was given the opportunity to make payments with mt rent payments that they would work with me. Since then I believe a new company bought these apartments and now I’ve been told that I have to pay all deposit balances no later than December 31st 2017. I have been making $50.00 payments with my July, August, September, November and managed to pay a $100.00 extra payment during August because I cancelled my car insurance per I couldn’t afford a car payment anymore.

    Well, on December 1st 2017 I will have the balance of $100.00 left on the regular deposit but I’m not going to be able to pay the pet deposit $150.00 by December 31st 2017. I just don’t have extra money and already can’t afford Christmas for my family. The manager Stephanie Cass said it has to be paid all deposits in full no matter what by December 31st.


    What’s going to happen to me? I can’t afford to move. The Crisis Center here in Athens helped me move here with volunteers. They can’t help me with this deposit issue.


    I’m scared and don’t know what to do. Please help me.

    Hello,


    My I live in a Housing Choice Voucher unit in Stanislaus County. My son has a developmental disability and is disabled and he recently was approved for IHSS and I am now his IHSS provider.


    Per Federal regulations under HUD 24 CFR 5.609 © (16) Amounts paid by a state agency to a family with a member who has a developmental disability and is living at home to offset the cost of services and equipment needed to keep the developmentally disabled family member at home.


    If child has developmental disability , and live with the provider who is their parent and is living at affording housing or any kind, then by law IHSS income is exempt according to 24 CFR 5.609 © (16)


    On the w-4 form, it will be written as 2014-7 EXEMPT.


    Changes were made to the Medicaid waiver program or IHSS for disabled persons who live and resides with their care providers. IHSS payments that I receny started receiving are deemed to be EXEMPT from federal taxes and are not to be consider as earned income or wages -but EXEMPT, which in essence means that income is ZERO.


    Please help me to assure that Stanislaus County housing commission fellows the regulations & educate them of the federal regulations code 24 CFR 5.609 © (16) and that it shall not be counted as income. They recent my informed me in person that HUD does not exclude IHSS income. I am aware that some counties are in compliance & others are not because they are not properly informed of the regulations.

    OUR HUD HOUSING APTS FOR ELDERLY & DISABLED : MANAGER IS SO OUT OF CONTROL. BULLING, MAKING UP OWN RULES, DISRESPECTFUL TO US & STAFF HERE . WE HAVE TENANTS ASSO. BUT NEED MUCH HELP ? THE BED BUG SITUATION HAS BEEN HERE FOR AT LEAST ONE YEAR & OTHER PEOPLE WHO HAVE LIVED HERE 15-30 YRS. SAID 3_8 YEARS. A 97 YR. OLD LADY HAD TO SPEND OVER $4500.00 ANOTHER COUPLE DISABLED SPENT OVER $3500.00 IN LAST FEW MONTHS. ANOTHER MAN HAD HIS APT SPRAYED 9 TIMES IN 2 MOS. & NOT EFFECTIVE. ASKED THE MANAGER IF HE COULD HAVE HIS OWN COMPANY TO GET RID OF THEM PERMANATELY. SPRAY IN WALLS, HAVE TO DRILL HOLES & THEN WILL PATCH & PAINT AS IF THEY NEVER HAD BEEN THERE FOR $1800.00 HE WOULD PAY FOR IT & SHE SAIDABSOLUTELY NOTALL APTS HAVE BEEN INVOLVED ARE NEXT TO ONE ANOTHER OR ABOVE ETC. SO MANY INCIDENTS WE HAVE RECORDED & SOME SIGNED AS VERY UPSET HERE & UNCOMFORTABLE IN THERE OWN HOME HERE.

    PLEASE IF U MAY HELP OR KNOW OF SOMEONE THATY COULD WOULD U PLEASE LET US KNOW AS ENOUGH IS ENOUGH? THANK U KINDLY FOR UR TIME

    We are a facility funded by HUD & have a young very nasty , but smart manager here that only makes more trouble & problems for the tenants who are elderly & disabled. we have tried all that we can, but need some body who knows how to handle this out of control disrespectful woman. we have 114 units & almost every one has been hurt or in some way disrespected & denied reasonable acomidations depending on who u are & her mood. Even the Cooridinator is ready to call it quits as she takes so much abuse buther hands are tied as works for owners of building but under HUD…Need advice..

    Dear Save Our Homes,


    I am a stockholder in a multi-family housing cooperative in Massachusetts which receives Section 236 & Section 8 assistance and is subject to the provisions of 245.100.


    My question is that in considering starting a Tenants’ Union/Organization, can and/or must the current Board of Directors be excluded from such meetings so as to abide by the requirement that meetings be “completely independent of owners, management, and their representatives.”


    Further, the statutes leave unclear whether stockholders in a cooperative are considered “owners” (they technically own shares in the corporation but no real estate).


    Any information or advice is much appreciated.

    Where can we find a list of regulations for our low income senior building in San Diego, CA. We have believed that HUD requires management to provide certain things to assure our safety and well being – such as: 24 hr access, space to meet, places to post our information for residents to know what’s going on, attention to our questions and concerns, etc. Is this true? How can we find out?

    My local HUD authority tells me that the “Resident Rights & Responsibilities” brochure referred to on this website is BLACKLISTED (their word) & that our lease supersedes any HUD regulation and/or handout. I am confused.

    Can the owners of our bldg stipulate that all resident questions, concerns, and complaints be funneled thru the President of our Resident’s Asso (me), who must then submit all questions, concerns, and complaints by email to the administrator of our bldg?

    I just read the part about organizing your complex and the retaliation you might get. THAT IS HAPPENING TO ME. They have given me a 3 day notice to quit or refrain from bring a “threat”. The statements they made are false and have effectively silence me. I spoke publically in a board meeting about them being out of compliance because there is no RAB (Res. Advsry. Cncl). I could use some support and legal advice. These guys play very rough! Thank you.

    Hello. My name is Liz O’Fallon. I live in Public Housing in So. Calif. and there are no tenant councils or RAB. The tenants living here are pretty intimidated and do not want to stand out by joining a council and I might be putting myself at risk by pursuing this.


    How do I go about doing this without putting my housing at risk? On your website you have tenant rights for section 8. Where can I find support for PUBLIC HOUSING RESIDENT’S RIGHTS?

    I have a question about Our tenants association and it’s legitimacy. We have not had a meeting in over 5 months and when you ask the president about it, she becomes combative. There is money in the treasury and there is speculation that she may be trying to dissolve the association and keep the money. Do you have any idea who can turn to to straighten this mess out ? Any advise would be greatly appreciated
